| In exercise of the powers conferred by section 21 of the Ogun State Environmental Protection Agency Law. 1995,and all other powers enabling it inthat behalf, the following Regulations are hereby made by the Agency. |

There shall be established in any part of the State as may be duly designated by the Agency. Vehicle Emission Test Centres ( hereinafter referred to as Test Centres) |

| |
The functions of the Test Centres shall include the inspection servicing and adjustments of vehicle emission systems |

| 1 |
As from the commencement of these Regulations, no vehicle shall be registered by the State Licensing Authority or sold within the State unless such vehiclehas undergone initial inspection andhas been duly certified by a licenced Vehicle Emission Test Centre. |

| 2 |
A test Centre shall only issue Certificates of fitness in respect of vehicles which comply, with the emission standards prescribed in Table A of the Fees for Emission Test page. |

| 3 |
After the initial inspection, every vehicle shall undergo periodic inspection at a Test Center, at least two times a year. |
| |
|
| 4 |
Without prejudice to the above provisions. Test Centres may also conduct from time to time, but with the prior approval of the Agency, random roadside inspections on all vehicles n the State. |

| 5 |
At every random inspection, the driver of a vehicle being inspected must produce upon demand by the designated officer on duty, a copy of the latest fitness Certificate issued in respect of the vehicle by a Test Centre. |

|
| 6 |
No renewal of registration shall be granted in respect of any vehicle unless the latest fitness Certificate issued in respect of such vehicle is presented to the registration authority. |

| |
No vehicle shall be used on public highway within the State whose emission is shown to exceed the permissible limit in a spot test on an initial test carried out by a Test Centre. |

| |
The fees prescribed in Table B of the Fees for Emission Test page shall be chargable for inspecting and testing the various categories of vehicle indicated therein. |

| 6 |

| |
Any person who neglects, refuses or fails to comply with the Foregoing Sections 2, 3, 4 of these Regulations commits an offence and on conviction shall be liable to the fines prescribed in Table C of the Fees for Emission Test page. |

The permissible emission limit for the specified generating sets shall be as prescribed in Table D of the Fees for Emission Test page. |

|
| 2 |
The fees precribed in Table E of the Fees for Emission Test page shall be chargeable for the inspection and certification of electricity generating sets |

|
| 8 |
| |
| |
Any person who neglects, refuses of fails to comply with the foregoing Regulation 7(1) and (2) commits an offence and on conviction shall be liable to the fine prescribed in Table F of the Fess for Emission Test page. |

In these regulations:
| |
Agency: means the Ogun State Environmental Protection Agency.
Designated Officer: means an officer duly delegaged by the Agency to enforce the provisions of these Regulations.
Person: includes individuals and corporate bodies whether registered of not.
State: means Ogun State of Nigeria.
Vehicles: means a mechanically propelled carriage intended or adapted for use on roads and includes a motorcycle and a tricycle. |

These regulations may be cited as the Environmental Protection Regulations, 2005. |
